Caros leitores e caras leitoras,

A Revista de Direito Sanitário
acaba de publicar seu último número -
volume 18, número 1 – e os artigos publicados tratam de temas que estão
na pauta das discussões sociais, políticas e econômicas do Brasil e do
mundo.

Começando pelo editorial sobre a nomeação do novo diretor-geral da
Organização Mundial da Saúde (OMS), Tedros Adhanom Ghebreyesus,
ex-ministro da Saúde e também ex-ministro de Relações Exteriores da
Etiópia. De autoria de Sueli Gandolfi Dallari, editora científica da
Revista, o texto destaca a transparência da eleição do novo
diretor-geral, com a extensão dos votos “aos Estados-Membros, e não
somente ao Comitê Executivo da OMS” e com a realização de debates
pré-eleitorais.

Já a seção “Tema em Debate” aborda os impactos da ação regulatória
da gência Nacional de Vigilância Sanitária (Anvisa) nas diferentes áreas
da saúde pública. A discussão é apresentada por Verônica Cruz,
professora da Universidade Federal do Rio de Janeiro, que destaca a
abrangência do campo de atuação da vigilância sanitária, “haja vista
sua função precípua, qual seja: a de proteger a saúde da população”.
Assim, a Anvisa, ao ultrapassar “os limites mais óbvios relativos às
questões sanitárias, encontra resistências de ordem política, econômica
e até mesmo moral na sociedade”, afirma Verônica.

Destacando a abrangência interdisciplinar do Direito Sanitário, a seção
“Artigos Originais” traz um artigo que tem como objetivo contribuir para
a operacionalização de pesquisas qualitativas no Direito Sanitário. Já
outro trabalho aborda a ecogenética, um ramo específico da genética, que
estuda a inter-relação entre o meio ambiente e as características
genéticas individuais que alteram as condições gerais de saúde. Temos
ainda um artigo do campo da filosofia jurídica que analisa o conceito de
desempenho, de performance, em relação à integralidade da assistência
nos sistemas regionais de saúde.

Outro destaque desta nova edição é o comentário à jurisprudência que
analisa a adoção dos Protocolos Clínicos e Diretrizes Terapêuticas como
parâmetro para auxiliar os tribunais nas ações judiciais relacionadas ao
direito à saúde.

Por fim, a seção “Jurisprudência” traz polêmicas decisões judiciais
da África do Sul, Colômbia e Índia.

10 Years Later, Guantanamo Is STIL

SAN JUAN, Puerto Rico -- Suleiman al-Nahdi waits with dozens of other prisoners in a seemingly permanent state of limbo five years after he was cleared for release from Guantanamo Bay.

"I wonder if the U.S. government wants to keep us here forever," the 37-year-old al-Nahdi wrote in a recent letter to his lawyers.

Open for 10 years on Wednesday, the prison seems more established than ever. The deadline set by President Barack Obama to close Guantanamo came and went two years ago. No detainee has left in a year because of restrictions on transfers, and indefinite military detention is now enshrined in U.S. law./.../

This recent letter from Professor Bernard Lown shows what can be considedred  a new prospect for Global Health with more peace and justice to an aching world.

Dear Friends,

The rapidly unfolding events in Tunisia brings hope to the ossified Arab world. Far too long Arabs have been overwhelmed by wretchedness, corrupt governments, bypassed by the enlightenment, shunted by the age of science and modernity.

Those of us who depend on corporate media to be informed about the world must be taken aback. Wasn't Zine el-Abdine Ben Ali an enlightened leader, a friend of democracies promoting Western values, who fostered prosperity for his people and helped stem the tide of crazed Islamic Jihaists?

I'm old enough to have lived through an endless list of Frankensteins who found favor in Washington. These were frequently launched with a connivance of the CIA and kept in power by our largesse.  Alphabetically–Omar Bango (Gabon), Fulgerncio Batista (Cuba), Papa Doc and son Jean Claude Duvalier (Haiti), Ferdinand Marcos (Philippines) Osama bin Laden (Saudi Arabia),), Hosni Mubarak (Egypt), Mobutu Sese Seko (Congo), Ngo Dinh Diem (Vietnam), Georgios Padapolos (Greece), Jonas Savimbi (Angola), Augusto Pinochet (Chile), Mohammad Rezā Shāh Pahlavi (Iran), Saddam Hussein (Iraq), Saudi monarchs (Saudi Arabia), Anastasio Somoza (Nicaragua), Alfredo Strösner (Paraguay), Suharto (Indonesia), Rafael Trujillo  (Dominican Republic), Zia al Haq (Pakistan).

Each of you, no doubt, can add to the murderous list of dictators that the USA sponsored. All were proteges of the Ameerican government irrespective whether republicans or democrats were in power. The variable justification for support was that they were fighting communism, drugs, and now terrorists. Washington maintained that they brought order and were readying their wayward countries for democracy.

Several key and analyses will not appear in Western media.

1. Events in Tunisia, in part, reflect diminution of global dominance by the USA.

2. The revolution in Tunisia is secular. Islamism is largely the consequence of continuing economic colonialism by the West, primarily the United States and its petroleum dominated foreign policy in the Arab world.

3.Tunisian events may be viewed as equivalent to the fall of the Berlin wall. There is likely to exert domino effects sweeping the Arab world. If it happened in Tunisia, no Arab country is immune.

4.The revolution will not be easily contained since it is indigenous and arises from below.

5. This last point deserves pondering. The events preceding the Tunisian revolutionare are similar to what is ongoing on a far more colossal scale in the USA–pacification of the masses by having until recently made available easy credit, inflow of cheap commodities, destruction of trade unions, impoverishment of the middle class, militarization of society, widening gap in income between the few and the many, and ultimately the wealth of the country concentrated in the Ben Ali family or in Wall Street.

Enclosed is an informative analysis that brings coherence to the unfolding events in Tunisia.

As this is still January, a wish for the new year.

May 2011 bring more peace with justice to an aching world

We hope it will be timely because the WIPO General Assemblies will take place in Geneva starting on 22 September. The legitimacy and usefulness of the IP system depends on the correct balance between the public interest and the private privilege given to the IP holders as an incentive for innovation. This balance has been disrupted by a one-size-fits-all global regime in the TRIPS agreement. Yet TRIPS has some flexibilities that can be used to limit the damage that an inappropriate IP system can generate./.../
